Truck Driver Facing Lawsuit After Fatal Wreck Kills Two

A victim from a fatal south Alabama crash has filed a wrongful death truck accident lawsuit against the driver who is allegedly responsible for the incident. The multi-vehicle crash occurred in Thomasville when a semi-truck struck four vehicles that were sitting at a red light in the southbound lane on Highway 43. As a result of the collision, two people were left dead and four others were injured. The Thomasville Police Department arrested and charged the driver of the truck with two counts of vehicular manslaughter. He currently resides in Clarke County Jail.

One of the victims, a Tuscaloosa resident, was among those injured and has now filed a personal injury lawsuit against the driver and his employers. The lawsuit was filed in the Clarke County Circuit Court and names 4 US Freight LLC, 4 US Transportation Company, and 4 US Corporation as defendants, along with the driver of the truck.

According to the lawsuit, the plaintiff was left with serious injuries after her red Nissan Rogue was hit by the semi-truck. “Following the impact, Calvert was left hanging upside down – strapped in by her seat belt and unable to extract herself from the vehicle,” the complaint says. “Calvert is fortunate to have been pulled from her vehicle by two bystanders, whom she views as heroes and wishes to be able to personally thank. Shortly after she was pulled from the Nissan Rogue, it caught fire and burned. The plaintiff is lucky to have survived the accident. She was transported by ambulance to Grove Hill Memorial Hospital, where she received treatment. Additional treatment is expected.

Allegations against the driver 

In this case, the driver plowed his semi-truck into the back of a line of vehicles that were waiting at a red light. The driver is accused of being “distracted and/or inattentive and/or impaired.” Dash cam video of the collision shows the truck slamming into four vehicles at a red light. The truck appears to completely crush two of the vehicles before colliding with the plaintiff’s Nissan. According to the plaintiff’s attorney, it demonstrates that the driver did not even attempt to use the brakes prior to the collision. “Widely circulated dash cam video of the crash shows no sign of the trucker applying his brakes before impact,” Hayes said, “We are committed to fully investigating this matter and are confident that all the facts will come out.”

The complaint alleges that the semi-truck driver negligently breached his duty of care to follow Alabama’s rules of the road by not protecting other motorists or being careful while driving. The complaint further alleges that the company that the truck driver worked for was negligent for failing to hire a competent driver.
